Terms & Conditions of Service

This binding contract governs all bookings, mountain excursions, cultural tours, and digital transactions facilitated through this platform.

Last Updated: October 2026 | Enforceable upon booking submission or payment clearance

1. Legal Entity & Joint Partnership

This platform (umcte.shf.co.tz) is jointly operated under an operational partnership between Uvidunda Mountain Cultural Tourism Enterprise (UMCTE) and Shimulimuli Heritage Foundation (SHF) ("the Partnership", "we", "us").

UMCTE (Ground Operations)

Responsible for certified local guide deployment, mountain trail navigation, village host coordination, and physical tour safety in Morogoro, Tanzania.

SHF (Digital & Legal)

Responsible for digital platform infrastructure, payment handling, legal compliance, personal data protection, and cultural documentation archives.

2. Bookings, Age Limits & Digital Transactions

  • Binding Acceptance: Submitting a booking, confirming via WhatsApp/email, or completing a deposit constitutes full legal acceptance of these Terms.
  • Age Requirement: Participants under 18 years of age must be accompanied by a parent, legal guardian, or an authorized responsible adult unless explicitly permitted in writing by the Partnership.
  • Settlement Methods: We accept payments via Tanzanian Mobile Money (M-Pesa, Mixx by Yas, Tigo Pesa, Airtel Money) and authorized card gateways (Visa/Mastercard). Bookings are confirmed only upon clearance of funds.
  • Currency & Intermediary Fees: All rates are quoted in Tanzanian Shillings (TZS) or US Dollars (USD). Participants are responsible for third-party bank charges, transaction levies, or currency conversion margins imposed by financial providers.

3. Cancellation & Detailed Refund Schedule

Because tour scheduling requires immediate allocation of village hosts, meal preparation, and local guides, cancellations are enforced according to the following schedule:

Cancellation Notice Refund Entitlement Terms & Retention Details
24 Hours or More Before Departure 100% Full Refund Full reimbursement of tour booking fees (excluding non-refundable payment gateway fees).
Less Than 24 Hours Before Departure 60% Partial Refund A mandatory 40% retention fee is held to compensate local hosts and cover non-recoverable preparation costs.
Failure to Arrive (No-Show) 0% Refund Complete forfeiture of funds where no written notice is provided prior to tour commencement.

Refund Request Procedure: All cancellation requests must be submitted in writing via email to bookings@umcte.shf.co.tz or through our official WhatsApp business channel.

Processing Window: Approved refunds will be processed within 7–14 business days using the original payment channel where feasible. Mobile money processing fees, bank charges, and foreign exchange variances are non-refundable.

4. Participant Responsibilities & Guide Authority

To maintain safety and protect local heritage, all guests agree to adhere to strict conduct guidelines during expeditions:

Participant Obligations:
  • Follow all instructions given by certified UMCTE mountain and cultural guides.
  • Wear suitable outdoor hiking footwear, appropriate clothing, and carry personal hydration/medication.
  • Refrain strictly from consuming alcohol, illegal substances, or impairing drugs during active trekking.
  • Respect local community customs, cultural heritage landmarks, and environmental conservation rules.
Guide Operational Authority:

Certified UMCTE guides have full authority to suspend, modify, or terminate any tour or trekking route where they reasonably believe continuing would present a risk to the physical safety, health, or security of participants, staff, or community members.

5. Physical Fitness & Emergency Medical Consent

Mountain trekking (including high-altitude trails in the Uluguru range) requires physical exertion. Guests must ensure they possess appropriate health and fitness levels for their chosen itinerary and disclose pre-existing conditions (e.g., asthma, heart issues, severe allergies) prior to departure.

Emergency Care Authorization: If a participant becomes ill or injured during a tour, the Partnership or its representatives are authorized to arrange emergency first aid, professional medical treatment, or field evacuation where reasonably necessary. Any associated medical, rescue, ambulance, or hospital costs remain the sole financial responsibility of the participant.

6. Limitation of Legal Liability & Risk Acknowledgment

The Partnership will exercise all reasonable care and skill in organizing and conducting tours. However, participants acknowledge that mountain trekking, outdoor trail walking, and remote cultural activities involve inherent risks, including uneven terrain, sudden weather changes, wildlife encounters, and physical exertion.

To the maximum extent permitted under the laws of the United Republic of Tanzania, the Partnership is not liable for losses, delays, or injuries arising solely from these inherent risks where reasonable safety measures have been maintained.

Nothing in these Terms excludes or limits liability for death, personal injury, fraud, or loss caused directly by the Partnership’s negligence, gross negligence, or willful misconduct where such liability cannot legally be excluded under Tanzanian law.

* Personal Belongings & Insurance: Guests are solely responsible for personal gear, mobile phones, and cameras. The Partnership does not provide personal accident insurance and strongly advises guests to obtain independent medical and travel insurance.

7. Force Majeure & Itinerary Modifications

The Partnership is not liable for failure or delay in fulfilling tour itineraries caused by events beyond its reasonable control ("Force Majeure"), including extreme weather conditions, swollen river crossings, landslides, civil unrest, road blockades, natural disasters, or official government restrictions. In such cases, the Partnership will offer alternative lowland cultural activities, reschedule the excursion, or issue credit where feasible.

8. Media Consent & Intellectual Property

Photography & Video Consent: During tours, authorized representatives of SHF or UMCTE may take photographs, video footage, or audio recordings for educational archives, cultural documentation, and promotional purposes. Guests consent to such non-commercial media usage. Participants who wish to opt out must inform the Partnership in writing prior to tour departure.

Intellectual Property: All content on this platform—including photographic archives, itinerary designs, text descriptions, software code, logos, and cultural educational materials—is the exclusive intellectual property of UMCTE and Shimulimuli Heritage Foundation, protected under Tanzanian copyright law.

9. Privacy & Data Protection

Personal information collected during booking (such as full names, contact numbers, national IDs/passports, and transaction references) is processed securely in accordance with applicable Tanzanian data protection legislation. For comprehensive details on data storage and user rights, please review our separate Privacy Policy.

10. Governing Law & Dispute Resolution

These Terms shall be governed by, interpreted, and enforced in accordance with the laws of the United Republic of Tanzania (including the Law of Contract Act [CAP 345 R.E. 2019]). Any legal dispute or claim arising out of these services shall first be submitted to good-faith informal resolution. If unresolved, the dispute shall fall under the exclusive jurisdiction of the competent courts of Dar es Salaam or Morogoro, Tanzania.
